Heard Mr. M A I Hussain, learned counsel the appearing for the petitioner. Also heard Mr. Bhaskar Sarma, learned Additional Public Prosecutor prays for the State of Assam. 2. This is an application under Section 438 read with Section 442 of the BNSS, 2023
Page No.# 2/2 praying for custody of a Scorpio Vehicle bearing Registration No.AS-22-H-6489, 3 (three) nos. of Real-Me mobile phones, which were seized in connection with Palashbari P.S. Case No.269/2025. 3. The vehicle and the aforesaid items along with a cash amount of ₹90,000/- and 3 (three) bank cheque books were seized in the name of the petitioner Akram Ali. 4. All those things were seized in respect of an allegation of illegal transportation of cattle. In the meantime, 15 (fifteen) numbers of cattle have already died. 5. The Investigation Officer has submitted a report stating that the petitioner Akram Ali is a kingpin of the aforesaid offences. 6. I have considered the submission made by the learned counsel of both sides. 7. This Court is of the opinion that keeping the aforesaid items in custody would not serve any purpose for the investigation of the case. 8. Therefore, the prayer of the petitioner is allowed. 9. It is hereby directed that the black colour Scorpio Vehicle bearing Registration No.AS-22- H-6489 shall be given to the custody of the present petitioner Akram Ali on taking a bond of ₹2 lakhs. The cash amount of ₹90,000/- shall be returned to the present petitioner Akram Ali on taking a bond of similar value. The 3 (three) nos. of Real-Me mobile phones shall also be given to the custody of the present petitioner Akram Ali on taking a bond of ₹3 lakhs. 10.
The petitioner shall submit the relevant documents regarding the aforesaid items to the concerned Investigating Officer. With the aforesaid direction, this Criminal Revision Petition stands disposed of accordingly. JUDGE Comparing Assistant
