……for the State. 1. The petitioners are the father-in-law, mother-in-law and brother-in-law of the victim/de facto complainant. The allegations are under Sections 498A/354A and 509 of the Indian Penal Code. They say that they have been falsely implicated. They responded to the notice issued by the investigating officer under Section 35 of the B.N.S.S. They pray for pre-arrest bail. 2. Learned State counsel confirms that the petitioners did report to the investigating officer pursuant to receipt of notice under Section 35 of the B.N.S.S.
3. I, therefore, see that the petitioners are co-operating with the investigating officer. Hence, their immediate
2 custodial interrogation may not be necessary so long as they continue to co-operate with the investigating officer. 4. Accordingly, in the event of arrest, the petitioners, namely Debendra Prasad, Malati Debi Prasad and Pinku Prasad shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that they shall meet the Investigating Officer of this case as and when called for. 5. In case the petitioners fail to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 6. The application for anticipatory bail, being CRM (A) 616 of 2026, stands disposed of. 7.
