Heard the parties. The petitioner has moved this Court for grant of bail in connection with Gandey P.S. Case No.47 of 2023 registered for the offences punishable under sections 147, 149, 341, 342, 302 of the Indian Penal Code. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was member of unlawful assembly and in prosecution of the common object of the assembly committed murder of Kamil Ansari. It is further submitted that the allegations against the petitioner are all false and the co-accused persons faced trial vide Sessions Trial No. 108 of 2024 and some of them faced trial vide Sessions Trial No. 12 of 2025 whereas the case of the petitioner was split up. It is then submitted that the informant Afsal Ansari who was examined as P.W.10 in the joint trial of S.T. Nos. 108 of 2024 and 12 of 2025 of the court of learned Additional Sessions Judge-X, Giridih has stated that he is an illiterate person and he has signed the paper where he was told to sign and he was declared hostile and even though the prosecution put leading question to him still he did not support the case of the prosecution. Similarly, out of the ten witnesses examined in that case, P.Ws. 1 to 3 and 5 to 9 have not supported the case of the prosecution and have turned hostile and
P.W.4 has only stated about seeing the dead body of Kamil Ansari. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.15 of the bail application. It is then submitted that the petitioner has been in custody since 05.02.2026, as has been mentioned in paragraph no. 16 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the co-accused persons with similar allegation have already been admitted to bail by the coordinate Benches of this Court. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Giridih, in connection with Gandey P.S. Case No.47 of 2023 with the condition that the petitioner will cooperate with the trial of the case and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the informant or the witnesses of the case in any manner during the trial of the case.
