Accused no.2 in Crime No.143/2026 registered by T.Narasipura Police Station, Mysuru District, for the offences punishable under Sections 309(6) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.143/2026 was registered by T.Narasipura Police Station, Mysuru District, for the aforesaid offences against unknown persons based on the first information dated 16.04.2026 received from Girish S/o late Lingappa. In the said case, petitioner was arrested on 11.05.2026 and remanded to judicial custody. In his remand application, petitioner is arrayed as accused no.2. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.756/2026 was rejected on 08.06.2026. In the first information dated 16.04.2026, the victim has stated that on 14.04.2026 after completing work at Yadatore toll, he had gone to his land to feed water and subsequently, when he returned to work at Yedatore toll at about 2.00 a.m., four persons who came in two motor cycles intercepted his motor bike and after threatening him asked him to hand over money. When he informed him that he has no money, they allegedly snatched his mobile phone and asked him to unlock the same. Thereafter, they assaulted him with a rod and went away. 5. Petitioner aged 20 years has been arrested in the present case on 11.05.2026 and remanded to judicial custody. The rod used to assault the victim has been recovered in the present case at the instance of accused no.1 who was arrested. Accused no.4 who was arrested in the present case has been granted regular bail by the jurisdictional court of Sessions Judge in Crl. Misc. No.693/2026 disposed of on 13.05.2026. The submission made by the learned Counsel for the petitioner that petitioner has no other criminal antecedents, is not seriously disputed by the learned HCGP. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.143/2026 registered by T.Narasipura Police Station, Mysuru District, for the offences punishable under Sections 309(6) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR CNR: KAHC010470752026 NC: 2026:KHC:42356 CRL.P No. 10131 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
