23/02/2026 D/L – 27 Court No.28 S. Kundu Rejected C.R.M.(A) 368 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Gangarampur P.S case no. 135 of 2025 dated 6/3/2025 under Sections 21(c)/22(c)/23(c)/27A/28/29 of the NDPS Act. In the matter of: Rafikul Mia @ Rafiqul Miya ...Petitioner. Mr. Koushik Chowdhury Mr. S. Panda Mr. Tridib Sur …for the petitioner. Mr. Saibal Bapuli Ms. Diksha Ghosh …for the State.
1. Report filed by the State is taken on record.
2. Learned counsel appearing for the petitioner submits that other than statements of the co-accused, there is no material available against the petitioner.
3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that although there are no money trail or phone calls record to implicate the present petitioner, there are several criminal antecedents against the petitioner some involving the NDPS Act and some in which proclamation has already been issued against the petitioner.
4. Considering the above, the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

5. Accordingly, the application for anticipatory bail is rejected.
