… for the State-respondent(s)
Learned advocate for the petitioners submits that they have been implicated in the instant case as they are the parents of the principal accused. Learned advocate for the State opposes the prayer for anticipatory bail and submits that in the statement under section 183 of the BNSS, the present petitioners have been named. I have taken into account the accusations so far as the present petitioners are concerned. Having considered the same, I am of the view that although the investigation may continue but custodial detention of the present petitioners may not be warranted.
2 Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Murtuj Alam @ Martuj Alam and Naseda Khatun @ Naseda] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner no.1 shall meet with the investigating officer of the case within a period of ten days from date and, thereafter, on all subsequent dates as would be fixed by the Investigating Officer of the case. So far as the petitioner no.2 concerned, she shall make herself physically available as and when she would be required by the I.O. of the case. Accordingly, CRM (A) 1671 of 2026 is disposed of.
