Mr. Lokendra Dobhal, learned counsel for the Applicant. 2. Mr. N.S. Kanyal, learned AGA, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Deepak Lal, who has been accused in Case Crime/FIR No.32 of 2025, under Sections 137 (2), 64 (1) of BNS and under Sections ¾ of the POCSO Act, at Police Station Chamba, District Tehri Garhwal. 4. As per the prosecution story, that on 02.10.2025, the victim/prosecutrix aged about 16 years, who is the daughter of the informant, namely, Swar Das, went somewhere on the wedding day of her brother, and despite a lot of search, when the victim was not traceable, the FIR was lodged by the informant. 5. Learned counsel for the Applicant submits for the consideration of the bail that the Applicant and the prosecutrix are in love relation with each other. He further submits that the prosecutrix pressured the Applicant to take her with him and when Applicant denied, then prosecutrix threatened the Applicant that she will commit suicide, and prosecutrix went with the Applicant with her own sweet will and the prosecutrix has also stated that she wants to marry Applicant and is ready to live rest of her life with the Applicant. Applicant counsel further submits that the prosecutrix has turned hostile and has not supported the prosecution story. The Applicant has no criminal history. 6. Learned State Counsel has objected the bail application of the Applicant with the contention that the Applicant is a minor girl aged about 16 years. 7. Considering the overall facts and circumstances of the case and the fact that the prosecutrix has turned hostile and has not supported the prosecution story, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed. It is directed that the Applicant - Deepak Lal, who has been accused in Case Crime/FIR No.32 of 2025, under Sections 137 (2), 64 (1) of BNS and under Sections ¾ of the POCSO Act, at Police Station Chamba, District Tehri Garhwal, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
