Rakib (Allowed) CRM (NDPS) 1630 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Durgapur Police Station case no. 438 of 2025 dated 24.10.2025 under Sections 20(b)(ii)(C)/25/29 of the NDPS Act. And In the matter of : Gyan Singh & Anr. ……Petitioners. Mr. Sandipan Ganguly, Sr. Adv, Mr. Moyukh Mukherjee Mr. Biswajit Manna Mr. Kunal Ganguly Mr. Kaustav Banerjee .....for the Petitioners. Mr. Ajay Ray Mr. Manoj Kumar Singh ……for the State. Learned senior advocate appearing for the petitioners submit that petitioners are in custody for more than ten months, charge- sheet has already been submitted before the jurisdictional Court and the total quantum of seizure in the present case is 26.479 kg of ganja. Learned advocate appearing for the State opposes the prayer for bail and submits that there are seven cases against the petitioners, however, none of the cases are under the NDPS Act except the present case. The charge-sheet reflects that there are 11 witnesses. Having considered that witness action has not commenced in the present case, I am of the opinion that some time will be required. As such, the petitioners may be released on bail. 2 Accordingly, the petitioners, namely, Gyan Singh and Kailash Singh @ Kailash Bur Singh shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 3rd Court, Asansol, Paschim Bardhaman. If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Paschim Bardhaman without prior permission of the learned Special Court. Thus, CRM (NDPS) No. 1630 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
