17.08.2026 Court No.35. D/L.282. Rakib (Rejected) CRM (A) 1872 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kalna Police Station case no. 272 of 2026 dated 24.04.2026 under Sections 329(4)/74/64/62/118(1)/351(2)/3(5) of the Bharatiya Nyana Sanhita, 2023. And In the matter of : Nitul Sarkar. ……Petitioner. Mr. Dhananjay Banerjee Mr. Archan Dutta Mr. Mohidul Islam Mr. Pralay Kr. Hazra .....for the Petitioner. Mr. L. Vishal Kumar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in connection with the instant case. There was a neighbouring dispute for which a false case has been foisted with the petitioner. There is a dispute for which the Civil Court has been approached. Learned advocate appearing for the State opposes the prayer for anticipatory bail. I have taken into account not only the statement of the informant but also an acquaintance who intended to speak with the accused being the present petitioner. The injury report along with the statement of injured itself speaks regarding the nature of injury inflicted by the present petitioner. As such, I am of the opinion that this is not a fit case for granting anticipatory bail. 2 Accordingly, prayer for anticipatory bail in CRM (A) 1872 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
