Sri.G.K.Shiva Prakash., counsel for the petitioners and Sri.Vignesh Shetty., counsel for the respondent appeared in person.
2. This writ petition is filed seeking following reliefs: a) Issue an orders/ direction in the name of writ of certiorari by quashing the impugned demand notice RC/194/2023 in O.A.No.413/2017 issued by office of the recovery officer-II dated:02.12.2023 on the file of the Debt Recovery Tribunal Bangalore (DRT-02) furnished as Annexure-A. b) Call for the records O.A.413/2017 on the file of the Debt Recovery Tribunal Karnataka at Bangalore (DRT-2). c) Issue an orders/ direction in the name of the writ of certiorari by quashing the impugned order in O.A.413/2017 dated 09.05.2023 on the file of the

Debt Recovery Tribunal Karnataka at Bangalore (DRT-2) furnished as Annexure-B. d) To pass such other order/ orders, as this Hon'ble Court deems fit to grant in the circumstances of the case in the interest of justice and equity.
3. Counsel for the respective parties urged several
contentions. Heard the arguments and perused the papers with care.
4. Suffice it to note that the Bank had filed O.A.No.413/2017 and the Tribunal vide
Order dated 09.05.2023 had allowed the O.A. Pursuant to the said order, recovery officer has issued a demand notice. If at all the petitioners have any grievance against the said demand notice, the appropriate remedy is to file an appeal under Section 30 of the RDDBFI Act, 1993. Hence, I decline to exercise power under writ jurisdiction. Accordingly, the writ petition is dismissed. The petitioners may approach appropriate forum, if so advised and if the law permits.

Because of dismissal the Writ Petition, interim order granted if any stands discharged and pending interlocutory applications if any are disposed of.
