1. The writ application has been preferred challenging the order dated 23rd June, 2025 passed by the Assistant Provident Fund Commissioner, Regional Office, Howrah under Section 14B and 7Q of the E.P.F. Act. Both the orders are appealable before the tribunal. But the petitioner has preferred the appeal being O.A. No. EPF-23 of 2026.
2. The same has been filed on 23rd June, 2026 i.e. beyond the period of limitation which is now subject to the consideration of the learned tribunal.
3. The petitioner submits that he has approached this court as there is no regular Presiding Officer.
4. This Court considering the fact that the appeal appears to be prima facie barred by limitation, is not inclined to grant any relief to the petitioner, at this stage.

5. The learned tribunal shall take a decision as to the limitation, in accordance with law, when the learned Presiding Officer-in-Charge hears the matter on certain days at the tribunal, at Kolkata.
6. Accordingly, the writ application is disposed of also with liberty granted to the petitioner to avail of the Vishwas Scheme, 2026, floated by the E.P.F. Organisation, if he wants to avail of the same.
7. WPA 16436 of 2026 stands disposed of.
8. There shall be no order as to costs.
9. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
