3. Petitioner’s father, namely Dhan Singh Panwar was employed as Forest Guard in Soil Conservation Forest Division, Kotbangla, Uttarkashi, who died while in harness, on
24.05.2025. Petitioner applied for compassionate appointment on 13.08.2025 and thereafter he also submitted reminder on
01.04.2026.
4. Since decision has not been taken on petitioner’s application, therefore, he has approached this Court seeking a direction to the competent authority to consider his claim for compassionate appointment.

Learned State Counsel points out that Mr. Surendra Singh, who also claims to be son of late Dhan Singh Panwar from his second wife, has applied for compassionate appointment; petitioner and respondent nos. 4, 5 & 6 have entered into a compromise, according to which, respondent no. 5 will have the right to get all the monetary dues of late Dhan Singh Panwar and also his property situate at Dehradun. He, therefore, submits that since there is dispute between the dependents of late Dhan
2026:UHC:2563 Singh Panwar as to which of the dependent will get compassionate appointment, therefore, difficulty is being faced by the competent authority in taking a decision.
6. Be that as it may, since the claim for compassionate appointment made by the petitioner as well as respondent no. 5 is yet to be decided by the competent authority, therefore, the writ petition is
disposed of with a direction to the competent authority to take decision on the rival claims of the parties for compassionate appointment and take decision, as per law, within three months. It goes without saying that petitioner as well as respondent nos. 4, 5 & 6 shall be heard, before taking any decision.
