For Petitioner(s): M/S.Gayathri Vasudevan For Respondent(s): Mr.M.Guruprasad, Govt’s counsel for R1 to 3 ORDER This writ petition has been filed against the impugned order dated 20.05.2025 passed by the 2nd respondent. 2. Mr.M.Guruprasad, learned Government's counsel, takes notice on behalf of the respondents. https://www.mhc.tn.gov.in/judis WP No. 18874 of 2026 __________ Page3 of 6 3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself. 4. The learned counsel for the petitioner would submit that in this case, the subject property, in town survey No.23/6, corresponding to old survey No.13/5 to an extent of 0.72 cents, is situated at ward A, Block 1, Singalandi Village, Thiruthuraipoondi taluk, Tiruvarur District. The patta, pertaining to the said property, was issued in favour of the petitioner as well as the 4th respondent. Aggrieved over the same, the petitioner filed an application for cancellation of Patta issued in the name of 4th respondent. Without considering the said application, the respondent had referred the parties to approach the Civil Court and agitate their rights over the said property vide impugned order dated 20.05.2025. Hence, this petition. 5. In reply, the learned Government's counsel appearing for the respondent would submit that there is a title dispute between the petitioner and the 5th respondent and the same can be decided only by way of filing a suit before the Civil Court. Keeping the said aspect in mind, the impugned order was passed by referring the parties to approach the Civil Court to established their right over the property. Hence, he request this Court to pass appropriate orders. https://www.mhc.tn.gov.in/judis WP No. 18874 of 2026 __________ Page4 of 6 6. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record. 7. In the case on hand, upon perusal of the impugned order, it appears that the patta was issued in favour of the petitioner as well as the 4th respondent. Now both the parties are claiming rights over the very same subject property. 8. In such case, as rightly contended by the official respondents, the title dispute cannot be decided by the revenue authorities and the same has to be agitated before appropriate Civil Court. Therefore, instead of filing an application for cancellation of patta, the petitioner is supposed to have approached the Civil Court and established his right over the subject property. When such being the case, there is no illegality or error on the part of the respondent in passing the impugned order. 9. In view of the above, this Court is inclined to dismiss the present petition as devoid of merits. Accordingly, this writ petition is dismissed. No cost. Consequently, the connected miscellaneous petition is also closed. 08-06-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No nsa https://www.mhc.tn.gov.in/judis WP No. 18874 of 2026 __________ Page5 of 6 To 1.
