The petitioner, is one of the member of Bharatiya Postal Employees Association, Group C, East Kolkata Division, has filed the present writ application challenging the order dated 22nd May, 2026 issued by the ADPS, Office of the Chief Postmaster General, West Bengal Circle, Kolkata. 2. Learned counsel for the petitioner submitted that the petitioner, being a member of the Association, has filed the present writ application. He further submits that the authorities are not appointing any observer for conducting the election of the Officer Bearer at the Divisional Conference. 3. This Court finds that the petitioner has filed this writ petition in an individual capacity. The petitioner has not filed any authorization or resolution from the Association that the Association has authorized the 2 petitioner to file the present writ application. This Court also did not find that from the impugned order dated 21st May, 2026, the petitioner will be affected anyway. If the petitioner has any grievance with regard to conducting the election of the Officer Bearers, the petitioner should have preferred an appropriate representation before the appropriate authority but in the present writ application, the petitioner has not prayed for any such prayer or a direction upon the authority for appointment of observer for conducting election of the Office Bearer. 4. Considering the above, this Court finds that the writ petition is not maintainable. 5. Accordingly, the WPA 13909 of 2026 is dismissed. However, the dismissal of the writ petition shall not prevent the writ petitioner from making any representation before the concerned authority for appointment of Observer for conducting the election. 6. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 7. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Krishna Rao, J.)
