IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE
WPA 7191 of 2024
Alhadi Tudu & Ors. -versus The State of West Bengal & Ors.
Ms. Sanchayita De
… For the petitioners
Mr. Lokenath Chatterjee, JSC Ms. Mary Datta Ms. Sneha Chatterjee
… For the State
1. Perused the instruction forwarded by the District Inspector of Schools (Secondary Education), Paschim Medinipur signed on 14th August, 2026.
2. It appears therefrom that the teacher expired-in-harness on 19th December, 2021 but hardcopy of the documents for processing the pension file were submitted before the head of the institution only on 29th August, 2022. On submission of the hardcopy of the documents, e-pension file of the petitioner no.1 was initiated and family pension was settled and Pension Payment Order issued on 27th December, 2022.
3. The petitioners have not annexed a single document to show the date when the documents were submitted by the petitioners before the school authority for initiation of the pension file. Without the formalities
2 being complied with by the petitioners, the question of issuance of Pension Payment Order does not arise at all.
4. Here it appears that the pension file was initiated in August 2022 and PPO issued in December
2022. There is hardly any delay requiring interference by the Court.
5. The writ petition fails and is, accordingly, dismissed.
6. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
7. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
