Order on Board 09/09/2026
1.
Learned counsel for the petitioner submits that the petitioner, who was appointed as Assistant Manager on 25.06.1990, is aggrieved by the impugned transfer order dated 17.07.2026, whereby he has been transferred from District Minor Forest Produce Federation, Narayanpur to District Minor Forest Produce Federation, Sukma, on the post of Junior Assistant. It is submitted that the petitioner had sought transfer to a nearby place in Durg on medical grounds and the said request was recommended by the concerned authorities and forwarded to the competent authority; however, the same was not considered while passing the impugned order. It is further submitted that the petitioner has also submitted a representation dated 20.07.2026, which is pending consideration.

2. On 07.09.2026, learned counsel appearing for respondents No.1 to 4 had sought some time and submitted that the process for transferring the petitioner to a place near Durg was under
consideration and that, on medical grounds, his posting was being considered at Bilaspur instead of Narayanpur.
3. Today, learned counsel appearing for respondents No.1 to 4, by placing on record a copy of the proposal dated 08.09.2026 submitted by the competent authority along with the covering memo dated 09.09.2026, submits that, keeping in view the health- related grounds of the petitioner and the availability of a vacant post at District Union, Bilaspur, the petitioner’s posting at Bilaspur has been proposed for consideration by the competent authority.
4. I have heard learned counsel for the parties and perused the material available on record.
5. From perusal of the proposal dated 08.09.2026, it appears that the petitioner’s request for transfer on medical grounds has been reconsidered and, taking note of the earlier recommendation for his posting at a District Union under Durg Circle and the availability of a vacant post at Bilaspur, his posting at Bilaspur has been proposed.
6. In view of the aforesaid development, particularly the proposal dated 08.09.2026 for consideration of the petitioner’s posting at Bilaspur, and further taking into account that an interim order dated 06.08.2026 is continuing in favour of the petitioner, no
4 fruitful purpose would be served in keeping the present writ petition pending.
7. Accordingly, the present writ petition is disposed of with a direction to the competent authority to take an appropriate decision on the proposal dated 08.09.2026 and pass the consequential order, posting the petitioner at Bilaspur, expeditiously.
8. The interim order granted vide order dated 06.08.2026 shall remain in force till the consequential posting order of the petitioner is passed by the competent authority. Sd/-
