The State of West Bengal Mr. Kushal Mumar Mukherjee, Mr. Arijit Bose …for the Petitioners Mr. Subir Ganguly, Mr. Sandeep Prasad Shaw …for the State The learned advocate appearing for the petitioners submits that warrants of arrest were issued against the petitioners in connection with G.R. Case No. 1782/2025, arising out of Raghunathganj Police Station Case No. 560 of 2025 dated April 27, 2025, under Sections 126(2), 117(2), 118(2), 103(1), 109(1), and 3(5) of the Bharatiya Nyaya Sanhita, 2023, after the learned Magistrate took cognizance of the offences upon submission of the charge-sheet. Thereafter, by an order dated December 23, 2025, the learned Magistrate issued a proclamation against the petitioners. It is submitted that, owing to a communication gap between the petitioners and their learned advocates, the petitioners could not appear before the learned Magistrate before the Court below. The learned advocate, however, submits that the petitioners are ready and willing to surrender before the learned Magistrate before the Court below within a period of three weeks from the date of this order. 2 In view of the aforesaid submission, the execution of the warrants of arrest and the proclamation issued against the petitioners shall remain stayed for a period of one month from the date of this order, subject to the condition that the petitioners shall surrender before the learned Magistrate within the said period. In the event the petitioners surrender before the learned Magistrate within the stipulated period, any application for bail filed by them shall be considered and decided in accordance with law, without being influenced by any observation made in this order. In the event the petitioners fail to surrender in terms of this order within the stipulated period, the warrants of arrest and the proclamation shall stand revived automatically, and the learned Magistrate shall be at liberty to execute the same in accordance with law. Accordingly, CRR 3238 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
