1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.94/2026 registered at Police Station Gunderdehi, District Balod (C.G.) for the offence punishable under Section 309(6) of GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.09.09 19:40:02 +0530

Case of the prosecution, in brief, is that on 05/03/2026 at about 1 pm the applicant along with co-accused persons have abused and assaulted the complainant party by means of hands and fist and on the point of knife have robbed gold and silver ornaments like ring and chain as also snatched Rs.8300/- cash. The incident was reported and based on the aforementioned allegations offence was registered and applicant was arrested on 07/03/2026.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the crime. He would submit that out of five co-accused persons, four co-accused persons have been enlarged on bail and case of the applicant is also on the similar footing. He would submit that the applicant is in jail since 07/03/2026 and conclusion of trial may take some time, hence, he be enlarged on bail.

On the other hand, learned State counsel would oppose the submission of learned counsel for the applicant and he would submit that the case of the applicant is different to that of the other co-accused persons who have been enlarged on bail. He submits that there are two other criminal antecedents registered against the applicant in the same police station bearing crime number 217/2025 and 232/2025.
5. I have heard learned counsel for the parties and perused the materials available on record.

Taking into consideration the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the fact that the applicant has not disclosed the offences as stated by learned counsel for the State, I do not find present to be a fit case to allow this application.
7. Accordingly, the bail application filed on behalf of the applicant is dismissed. Sd/-
