Learned counsel for the petitioner submits that the petitioner is a Assistant Teacher (LB), was transferred under the rationalization policy from Government Primary School, Durg to Government Primary School, Agar, Block Dhamda. Due to medical reasons, the petitioner could not join at the transferred place, and therefore, the D.E.O. passed an order of suspension dated 07.11.2025 against the petitioner. Learned counsel submits that on 11.12.2025, a charge-sheet was issued to the petitioner, to which he submitted his reply. However, the District Education Officer, without conducting any departmental enquiry or affording the petitioner a proper opportunity of hearing, passed the order of dismissal from service on 08.06.2026. Against the said order, the petitioner preferred an appeal before the Joint Director, Education, Durg on 12.06.2026, which is still pending, has not yet been considered and remains pending till date.
3. Per Contra, learned counsel for the respondents would submit that if the appeal preferred by the petitioner is still pending
consideration, the same will be decided within a period of 45 days in accordance with law.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Considering the submissions advanced by learned counsel for the parties and without expressing any opinion on the merits of
3 the case, the present writ petition is disposed of with a direction to respondent No.4 to consider and decide the petitioner's appeal Annexure P-4, in accordance with law on its own merits, within a period of 45 days from the date of receipt of copy of this order. SD/-
