Affidavit of service filed in Court today is taken on record. 2. The petitioner claims to be an Assistant Teacher of Titagarh Anglo Vernacular High School (HS). He alleges that the Headmaster of the school has undertaken various construction/renovation works of high value in the school without inviting tenders. 3. Apart from the construction work, allegations have been made for collecting excess fees from students without issuing receipts and irregularity in the implementation of the PM POSHAN Scheme. Several other allegations have also been made against the Headmaster of the school. 2 4. Learned advocate representing the Headmaster denies all the allegations made against the Headmaster of the school. 5. On a perusal of the writ petition, it appears that the petitioner is yet to lodge a formal complaint against any irregularity committed by any person of the school before the competent authority. In the absence of a formal complaint, it is not possible for the Court to direct any of the authorities to take steps to respond to the complaint of the petitioner. 6. In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to make a formal complaint before the District Inspector of Schools (Secondary Education), Barrackpore, North 24-Parganas. 7. In the event such a complaint is lodged, then the District Inspector of Schools (Secondary Education), Barrackpore, North 24-Parganas shall take steps to consider the same in accordance with law after giving reasonable opportunity of hearing to all the necessary parties. 8. If any allegation of the petitioner is found to be true, then necessary remedial steps shall be taken by the District Inspector of Schools (Secondary Education), Barrackpore, North 24-Parganas without any further delay. 9. The writ petition stands disposed of. 3 10. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court. 11. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities. (Amrita Sinha, J.)
