1. Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the impugned order dated 18.10.2023 (Annexure P-5). Further a writ of mandamus has been sought, directing the respondents to reimburse the amount of Rs.2,33,666/- incurred by the petitioner for medical treatment of her father-in-law along with interest @ 18% per annum from the date of submission of the reimbursement claim till the date of actual payment.

Learned counsel for the petitioner has, inter alia, contended that the petitioner is serving as a JBT Teacher in the Education Department, Haryana, and is presently posted at Government Model Sanskriti Primary School, Jhorarnali, District Sirsa. CWP-24551-2026 2 the petitioner's father-in-law, namely Shri Mahavir, was a senior citizen, who was wholly dependent upon the petitioner and residing with her. During his illness, he remained admitted in Gitanjali Hospital, Hisar from 10.03.2023 to 17.03.2023 and again from 16.06.2023 to 24.06.2023, and the petitioner incurred medical expenses amounting to Rs.2,33,666/- on his treatment as discernible from Annexures P-2 and P- 3, respectively, however, Sh. Mahavir expired on 24.06.2023 during treatment. It is further submitted that the petitioner submitted her medical reimbursement claim on 18.09.2023 through proper channel, but the same was rejected by respondent No.3 vide memo dated 18.10.2023 (Annexure P-5) solely on the ground that the income reflected in the Family ID was between Rs.75,000/- and Rs.1,00,000/- and, therefore, the deceased could not be treated as dependent upon the petitioner. Feeling aggrieved, the petitioner, thereafter, served a legal notice dated 24.02.2025 (Annexure P-6), seeking redressal of her grievance, which remained unheeded.

Learned counsel for the petitioner submits that he would be satisfied if the legal notice (Annexure P-6) of the petitioner is decided by respondent No.2 by passing a speaking order in a time bound manner.
3. Learned State counsel, appearing on advance notice, submits that he has no objection, in case a direction is issued to the respondent No.2 for time-bound consideration and decision of the legal notice (Annexure P-6) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent No.2 is directed to consider the legal notice (Annexure P-6) of the petitioner and examine the case of the petitioner dispassionately strictly in accordance with law and in view of the eligibility conditions in the medical reimbursement policy and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.2.
