The petitioners are apprehending their arrest in connection with Charhi P.S. Case No.69 of 2025, for offence registered under sections 191(2), 190, 109(1), 115(2), 352, 351(2) of BNS, pending in court of learned Judicial Magistrate, First Class, Hazaribagh.

Learned counsel for the petitioners submits that altercation took place due to cultivation of paddy in the field and there are general and omnibus allegations against all the accused persons of assault. He also submits that injury is said to be simple.
4. Learned State counsel opposes prayer and submits that on the vital part the assault has been made on the body of the informant.

Looking to the contents of the FIR, it transpires that there is direct allegation against the petitioner no.2, namely, Sunil Soren @ Sunil Manjhi of assault on the head by rod and pursuant to that, the injury has been received, and in that view of the matter, I am not inclined to grant anticipatory bail to the petitioner no.2, namely, Sunil Soren @ Sunil Manjhi, and as such prayer for anticipatory bail so far as the petitioner no.2, namely, Sunil Soren @ Sunil Manjhi is concerned, is hereby, rejected.
6. So far as the rest of the petitioners, i.e., petitioner nos.1 and 3 to 9 are concerned, there are general and omnibus allegations against them and altercation took place due to land dispute and as such, I am inclined to grant anticipatory bail to petitioner nos.1 and 3 to 9.

Accordingly, petitioner nos.1 and 3 to 9 are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioner nos.1 and 3 to 9, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Hazaribagh, in connection with Charhi P.S. Case No.69 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
