In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gangarampur Police Station Case No. 741 of 2025 dated 22.11.2025 under Sections 21(c)/22(c)/23(c)/27A/28/29 of the NDPS Act.
And In the matter of : Saleem Miah @ Salim Miya
……Petitioner.
Mr. Kaushik Choudhury
……for the Petitioner.
Mr. Anindya Ghosh Mr. Pronojit Roy
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for about 3 months. There has been no seizure from the present petitioner and the subject matter of the case relate to alleged recover of 113 bottles of Wincerex Cough Syrup.
Learned advocate for the State opposes the prayer for bail and submits that there are two previous criminal cases against the petitioner.
I have taken into account the report which has been submitted which reflects that Gangarampur PS Case No. 629 of 2025 and Gangarampur PS Case No. 135 of 2025 being
2 registered against the petitioner. Both the cases relate to NDPS Act.
Having considered the complicity of the petitioner in previous offences under the NDPS Act, I am not inclined to release the petitioner on bail.
Accordingly, CRM (NDPS) 1669 of 2026 is dismissed.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
