Learned advocate appearing for the petitioners submits that although there were alleged recovery of more than 2 kgs. of brown sugar but the chemical examiner’s report in respect of the individual packets which were seized do not respond to commercial quantity of contraband being seized. It has also been contended that the directions which were passed in CRM(NDPS)848 of 2025 although the same was informed but till date in the six months the same has not been adhered to.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the quantum of seizure as also
2 the chemical examiner’s report the threshold relating to commercial quantity could not be overcome by the petitioners so far as the recovery is concerned and quantification is concerned.
Accordingly, the rigors of Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioners is rejected.
I find that the petitioners are in custody for 1 year 11 months. Only one witness till date in part has been examined. Learned trial court would fix schedule and ensure that the seizure list witnesses and relevant other witnesses are examined at the earliest.
With the aforesaid observations, CRM(NDPS)1642 of 2026 is disposed of.
