Learned Advocate appearing for the petitioners submits that a civil dispute has been given the colour of a criminal case and that the present petitioners have been falsely implicated in the instant case. He submits that a dispute arose regarding the occupation of the office room and, in order to clear such occupation, petitioner no. 9, who happens to be the owner of the property, along with some other persons, has allegedly committed the offence. He submits that the accused persons may be granted anticipatory bail. 2. Learned Advocate appearing for the State produces the case diary and opposes the prayer for anticipatory bail of the present petitioners. 2 3. Heard the learned Advocates appearing for the respective parties and perused the case diary and other materials on record. In the FIR, it is alleged that the accused persons ransacked all the rooms; however, there is no seizure list of any broken goods or articles, and the incident allegedly occurred in the presence of direct evidence. Accordingly, this Court is of the view that custodial interrogation is not necessary and that the benefit under Section 482 of the BNSS can be extended in favour of the petitioners. 4. In view of the above, the prayer for anticipatory bail is allowed. 5. Accordingly, I direct that in the event of arrest, the petitioners viz., (1) Sourav Bag, (2) Rupchand Bag, (3) Prasanta Sardar, (4) Sanat Kumar Roy and (5) Mousumi Bag be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition petitioners, viz., (1) Sourav Bag, (2) Rupchand Bag, (3) Prasanta Sardar, and (4) Sanat Kumar Roy shall meet the investigating officer once in a week until the submission of charge-sheet. 6.
