Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused and there has been no recovery from the present petitioner.
Learned advocate for the State opposes the prayer for bail but is unable to refute such contentions advanced by the petitioners.
Subject matter of the case relate to alleged recovery of 181 bottles of Codeine Phosphate solution. Charge sheet has already been submitted.

State is unable to apprise this Court as to whether there are previous antecedents or Call Data Records or money trail available so far as the present petitioner is concerned.
In view of the aforesaid, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sekh Anowar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1657 of 2026 is allowed.
