02/ 06.02.2026: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Satgawan P.S. Case No. 99 of 2024 registered under sections 324(2), 115, 303(2), 351 (2), 109(1), 118(1)/3(5) of BNS and section 24 of Cattle Tress Pass Act read with section 92 of the Right of Persons with Disabilities Act, pending in the Court of learned J.M., Ist Class, Koderma.

Learned counsel for the petitioners submits that petitioner no.2 lodged Satgawan P.S. Case No. 98 of 2024 and thereafter the present case has been filed by the informant against the petitioners and all family members have been implicated. He further submits that there are general and omnibus allegation against all the accused persons. He next submits that the petitioners have got no criminal antecedents which is disclosed in para 13 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there and injury has been found grievous.

Looking into contents of F.I.R, it transpires that there are

general and omnibus allegation against the petitioners, it is not clear that from whose blow injury has been received, there are case and counter case between the parties and petitioners have got no criminal antecedents which is disclosed in para 13 of the petition, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned J.M., Ist Class, Koderma, in connection with Satgawan P.S. Case No. 99 of 2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
