Mr.Habibulla Shaik, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, he prays that the present petition be allowed. 3. Per contra, Ms.P.Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner. It is further submitted that though absconding charge sheet has been filed in this case, the petitioner, who is shown as Accused No.9, was absconding. It is also submitted that two similar criminal antecedents have been 3 Dr.YLR,J Crl.P.No.4319 of 2026 Dated 22.06.2026 reported against the petitioner. Hence, it is urged that the petition be dismissed. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, this is the second bail application filed by the petitioner/Accused No.9. A Coordinate Bench of this Court, in Crl.P.No.2305 of 2026, dismissed the earlier bail application on the ground that the Test Identification Parade had not been conducted. Even as of now, the Test Identification Parade has not been conducted, as submitted by the learned Assistant Public Prosecutor. The charge sheet has been filed showing the petitioner as Accused No.9 and as absconding. Subsequently, the petitioner was apprehended and arrested on 07.05.2025 pursuant to the execution of a Non-Bailable Warrant. He has been in judicial custody for the past 413 days. 6. It is pertinent to mention that the petitioner has also indulged in two other crimes, vide Crime No.354 of 2019 and Crime No.177 of 2020, for similar offences. With regard to the alleged role played by the petitioner, the investigation is not completed. There is no change in circumstances from the dismissal of the first bail application till the filing of the present subsequent bail application. 4 Dr.YLR,J Crl.P.No.4319 of 2026 Dated 22.06.2026 7. Having regard to the recorded complicity of the petitioner in the commission of the offence, the facts and circumstances of the case, the nature of the evidence available on record, and the pendency of the investigation, this Court is not inclined to enlarge the petitioner/Accused No.9 on bail at this juncture. Accordingly, the Criminal Petition is liable to be dismissed. 8. In the result, the Criminal Petition is dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
