17.08.2026 Sl. No. 7 Ct. No. 446 SG [ALLOWED] C. R. M. (A) 2123 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hanskhali Police Station Case No. 387/2026 dated 25.04.2026 under Section 108 of the Bharatiya Nyaya Sanhita, 2023 (G.R. Case No. 1714 of 2026). And In Re: Sukanta Biswas. … … Petitioner Ms. Minoti Gomes. … … for the petitioner Mr. Amal Kumar Datta, Mr. Rishav Kumar Thakur. … … for the State 1. Learned Advocate appearing for the petitioner submits that, following the incident of suicide of a lady, the present petitioner has been falsely implicated in this case out of personal grudge. She submits that the prosecution has miserably failed to collect any cogent material to justify its case that the present petitioner abetted the victim to commit suicide. She submits that, in this case, if the petitioner is compelled to remain in custody, he will be highly prejudiced and his liberty should not be curtailed for this reason. 2. Learned Advocate appearing for the State produces the case diary and opposes the prayer for anticipatory bail of the present petitioner based on the materials available on record. 3. The post-mortem report indicates that a non-continuous ligature mark was found on the neck of the victim, which prima facie suggests that the victim committed suicide. The petitioner 2 is a married person, and the call detail records collected by the prosecution also indicate that the victim and the petitioner had a telephonic conversation for the last time on 25th March, 2026. Considering all these aspects, this Court is of the view that custodial interrogation will not serve any purpose. 4. In view of the above, the prayer for anticipatory bail is allowed. 5. Accordingly, I direct that, in the event of arrest, the petitioner, viz., Sukanta Biswas, be released on bail upon furnishing a bond of Rs. 10,000/-, with two sureties of like amount each, one of whom must be a local surety, to the satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia, and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, and on the further condition that the petitioner shall meet the Investigating Officer once a week until the submission of the charge-sheet. 6. The application for anticipatory bail is, thus, disposed of. (Partha Sarathi Chatterjee, J.)
