Mishra … for the respondents January 8, 2026 [SR] Item No.12 The petitioner prays for a direction upon the respondent authorities to provide electricity connection to the writ petitioner’s house located at the place mentioned in the writ petition. It is now settled law that even a trespasser in settled possession of a property is entitled to electricity connection irrespective of his right, title and interest therein. The writ petitioner, therefore, if is in occupant of the property in question is entitled to electricity connection irrespective of her status in law. The petitioner claims to be occupying a government revenue land. If the petitioner is in settled possession therefore, is entitled to electricity connection. The aforesaid settled position of law will appear from several judgments of which one may refer to the Full Bench decision in the case of Abhimanyu Mazumdar vs. The Superintending Engineer reported at AIR 2011 Cal 64 and the judgment and order dated 6th September, 2024 in WPA/357/2024 ( M.S.Rajendran vs. The Superintending Engineer, Electricity Department and another) 2 Accordingly, I dispose of this writ petition by directing the respondents to process the writ petitioner’s application for electricity connection and provide such connection unless there is some absolute bar in law or there are some other compelling reasons for not allowing the petitioner’s application for electricity connection. The connection will be provided subject to the writ petitioner complying with all necessary formalities. The exercise should be completed within a period of eight weeks from date.
