JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners - accused Nos.1 and 2 are before the Court calling in question the registration of a crime in Crime No.103/2025 registered for offences punishable under Sections 506, 34, 120B, 419, 406, 504, 471, 468, 465 and 420 of the IPC. 2. Heard the learned Senior counsel, Sri.M.T. Nanaiah appearing for the petitioners and the learned Additional SPP-I, Sri.B.N. Jagadeesha appearing for respondent No.1. 3. Facts adumbrated are as follows: It is the case of the complainant that the petitioners - accused Nos.1 and 2 claim to be the leaders of the Congress Party and are further claiming that they would get jobs in various departments, allegedly get online payments of Rs.5,30,00,000/-. The assurance was that they would get the jobs and the appointment orders, as the case would be. In furtherance whereof, it transpires that the petitioners create an email ID for a period of 3 months and secure the presence of - 4 - HC-KAR CNR: KAHC010445482026 NC: 2026:KHC:36330 CRL.P No. 9571 of 2026 all those persons, who had paid money for the purpose of training in Kolkatta or other places. The persons who paid money are said to have appeared at the respective departments, are allegedly fake and are said to have indulged in training and then come to know the foul play and began to demand money. Those persons do not register the complaint, but the complainant, who has now registered the complaint is said to have an axe to grind against the present petitioners, as they have a separate transaction. The transaction is with regard to dishonour of a certain cheque, which is now questioned by these petitioners before the competent Court. The complainant therefore registers the crime by drawing all these activities of these petitioners into the fulcrum of the complaint. The complaint becomes a crime in Crime No.103/2025. The registration of the crime is what has driven the present petitioners - accused Nos.1 and 2 to the doors of this Court. 4. Learned Senior counsel, Sri.M.T. Nanaiah appearing for the petitioners would vehemently contend that not one person who has been allegedly hoodwinked by these petitioners - 5 - HC-KAR CNR: KAHC010445482026 NC: 2026:KHC:36330 CRL.P No. 9571 of 2026 has registered the complaint. The complainant is nobody or does not have any transaction concerning this issue with the petitioners. Therefore, the crime is registered only to wreak vengeance or as a counterblast to the proceedings under Section 138 of the N.I. Act, instituted by the petitioners against the complainant. 5. Learned SPP-I, Sri. B.N. Jagadeesha, would however refute the submissions contending that the petitioners ran a cartel of production of fake appointment orders, creation of fake email ID, allegedly generating employment, then fake training centres. It is then, when the complainant sets the criminal law into motion by registering the crime on 17.11.2025, the prosecution comes to know of all the activities that the petitioners have undertaken and an amount of Rs.5,30,00,000/- being received from general public who have been hoodwinked in desire of getting jobs in various government departments. Above all, the petitioners claim that they are Congress party leaders. Learned SPP-I further submits that the investigation papers would clearly reveal all the payments being received by these two people from the hands - 6 - HC-KAR CNR: KAHC010445482026 NC: 2026:KHC:36330 CRL.P No. 9571 of 2026 of those persons who were given those fake appointment letters or created fake departments, fake email ID and other activities. He would thus seek dismissal of the petition. 6. I have given my anxious consideration to the respective submissions made by the learned counsel and have perused the material on record. 7. The issue at this juncture lies in a narrow compass. Since the entire issue gets triggered from registration of the complaint, it is germane to notice the complaint. The complaint, on a prima facie reading, is not a bald recital of vague or omnibus allegations. It unfolds, with considerable detail, the entire modus operandi allegedly employed by the petitioners. The narrative commences with the receipt of ₹25,00,000/- from seven aspirants, followed by collections from three more persons and, thereafter, eight others. The investigation, at this stage, indicates that the cumulative online transfers made by several unsuspecting individuals to the petitioners aggregate to an astounding ₹5,30,00,000/-. Every payment, according to the complaint, was made in the fervent hope of securing Government employment, the petitioners having allegedly held out an unequivocal assurance that appointments in various Government departments were well within their reach. 9. Had the allegations rested merely on the receipt of money coupled with an unfulfilled promise of employment, the matter may have presented an altogether different complexion. The complaint, - 14 - HC-KAR CNR: KAHC010445482026 NC: 2026:KHC:36330 CRL.P No. 9571 of 2026 however, travels far beyond a mere allegation of inducement. It portrays a meticulously choreographed design intended to lend an aura of authenticity to the deception. The petitioners are alleged to have created fictitious email IDs, fabricated appointment orders, invented non-existent Government establishments and projected sham places of employment. To complete the illusion, the unsuspecting aspirants were allegedly dispatched to places such as Kolkata and Maharashtra for what was represented as official training programmes, all founded upon fabricated appointment letters and non-existent recruitment processes. It was only thereafter that the façade is said to have crumbled, revealing that the appointments, the departments, the communications and the training programmes were nothing more than an elaborate charade. 10. It is no doubt true that none of the persons who are alleged to have parted with their hard-earned money have themselves approached the police. Yet, that circumstance, by itself, neither effaces the allegations nor eclipses the detailed - 15 - HC-KAR CNR: KAHC010445482026 NC: 2026:KHC:36330 CRL.P No. 9571 of 2026 narration contained in the complaint. The fulcrum of the prosecution is not the identity of the complainant alone, but the elaborate account of the alleged fraudulent enterprise, setting out with specificity the manner in which innocent job aspirants were allegedly lured, induced and systematically deceived. 11. The facts, as they presently emerge from the record, read less like an ordinary criminal complaint and more like the script of a classic potboiler, where every succeeding act unveils a deeper layer of calculated deception. The allegations, if ultimately established, disclose not an isolated act of cheating but a carefully engineered scheme designed to prey upon the aspirations of unemployed youth, exploiting their hope of securing Government employment for unlawful pecuniary gain. 12. This Court, exercising its extraordinary jurisdiction, cannot be persuaded to extend its protective umbrella to those against whom the accusations, at this stage, reveal the alleged creation of fabricated appointment orders, fictitious email IDs, sham training centres and non-existent Government - 16 - HC-KAR CNR: KAHC010445482026 NC: 2026:KHC:36330 CRL.P No. 9571 of 2026 departments, all for the purpose of duping innocent and gullible citizens. It is a classic case of fake in uno fake in omnibus, as the allegations portray an edifice allegedly built entirely upon fabrication and falsehood. 13. Finding, therefore, no ground whatsoever to interdict the investigation or to invoke the extraordinary jurisdiction of this Court at this nascent stage, the petition merits no indulgence and is, accordingly, dismissed.
