The petitioner is alleged to have joined the cyber fraudsters who induced the complainant to part with an amount of Rs.1,26,548/-. An amount of Rs.82,250/- was withdrawn from the complainant bank account and was transferred in his bank account by using it as a mule account. The allegations levelled against the petitioner are duly supported by investigation. His role has clearly emerged during investigation. The offence in question is not an isolated act but is part of an organized cyber fraud wherein banking channels forms a crucial link in execution of the crime. Cyber crimes are steadily increasing and have a deep-rooted impact on the society targeting unsuspecting citizens and eroding public confidence in digital platforms. Such offences are serious economic crimes, effecting not only the victim but the financial system at large and, therefore, require a strict approach at the stage of grant of bail. Taking into consideration the gravity of the allegations as levelled against the petitioner, the implication which the release of the petition might have, the likelihood of his fleeing from justice or tampering with evidence, this Court is of the considered opinion that the petitioner does not deserve to be extended benefit of bail.
