In this application, the petitioner has assailed the order dated 6.8.2025 by which the court below has rejected the petitioner’s prayer for defreezing the bank account no. 00000010567099385. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that the order of the learned court below is bad in law and also violates the fundamental rights of the petitioner and the petitioner is severely jeopardized and prejudiced by that order. He further submits that he is suffering from illness and requires urgent hospitalization as per the medical advice and as such, he is unable to avail medical treatment as his salary is being completely blocked for almost a year. It is in fact severely challenging the petitioner’s right to life as the entire bank account of the petitioner is being frozen under the garb of investigation. The action taken by the police is arbitrary and motivated 2 and the report dated 6.8.2025 by the police is frivolous and ex-facie bad in law and is liable to be set aside. Learned counsel for the State submits that an amount of Rs. 20,00,000/- has been allegedly transferred to the account of the petitioner, which is the proceeds of crime and therefore, if the said account is defreezed after securing the said sum of Rs. 20,00,000/-, the State has got no objection. Having heard learned counsel for the petitioner and the State, the instant application being CRR 1110 of 2026 along with CRAN 1 of 2026 are disposed of with a direction upon the Bank authority to defreeze the petitioner’s bank account no. 00000010567099385 after securing Rs. 20,00,000/- in the said account.
