… Petitioner(s)
Mr. Arunangshu Chakraborty Mr. Maheswar M. Das Mr. Arijit Bera
… for the petitioner(s)
Mr. Krishnendu Bhattacharjee, ld. APP Mr. Mukesh Kr. Gupta
… for the State-respondent(s)
Learned advocate for the petitioner submits that with the change of administration, the present petitioner along with the others have been implicated in the present case. Learned Additional Public Prosecutor appears for the State and opposes the prayer for anticipatory bail. I have taken into account the accusations which relate to the incidents of 2014, 2017 and 2023. Having considered the same, I am of the opinion that although investigation may continue, but, custodial
2 detention of the present petitioner may not be warranted in the facts and circumstances of the case. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Ipsita Sarkar] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall meet with the investigating officer of the case as and when she would be required by the I.O. of the case. Accordingly, CRM (A) 1721 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
