This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (BNSS) has been filed by the applicant, who is apprehending her arrest in connection with Crime No.194/2026 registered at Police Station City Kotwali, Dhamtari, District Dhamtari (C.G.) for the offence punishable under Sections 353 (2) of BNSS. Case of prosecution, in brief, is that applicant through her personal Facebook profile uploaded indecent, inappropriate and objectionable post, including pictures, pertaining to the Chief of the Rashtriya Swayamsevak Sangh (RSS), which has badly damaged his image and reputation in general public. 3. Learned counsel for applicant submits that mistakenly the said post was shared by applicant on her Facebook account and as soon as she realized the mistake, she immediately deleted the same from her social media account and also apologized for her mistake on her facebook account by posting unconditional apology. He further submits that the applicant is 64 years old lady suffering from various serious ailments (Obstructive Sleep Apnea Ashtma/ Cardiac issues) and requires non- invasive Ventilation (NIV) support while sleeping and in support thereof, he has annexed medical reports along with bail application as Annexure A-5. Hence, arrest of applicant will badly affect her health condition. He further submits that there is no criminal antecedent against the applicant and she is ready to furnish bail as per the order, abiding with all conditions imposed by the Court. 3
4. On the other hand, learned State counsel opposes the bail application of present applicant and submits that post uploaded by applicant amounts to public mischief and therefore, she may not be extended benefit of anticipatory bail. 5. Heard learned counsel for the parties. 6.
Considering the facts and circumstances of the case, nature and gravity of offence, the fact that there is no criminal antecedent against the applicant, without commenting anything on merits, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the anticipatory bail application of applicant is allowed and it is directed that in the event of arrest of applicant – Smt. Surya Prabha Chettiar, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) she shall not act in any manner which will be prejudicial to fair and expeditious trial. 4 (c) she shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
