VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MRS. JUSTICE K.S. HEMALEKHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 09.01.2025 passed by the learned Single Judge of this court in W.P.No.26350/2024 (S-RES). 2. The complainant had filed the said petition, inter alia, praying that directions be issued to the accused to consider his representation dated 14.06.2024 and to further change the Enquiry Officer and the Departmental Nominee appointed under Rule 21(2) of the Karnataka Educational Institutions (Recruitment and Terms and Conditions of Service of Employees in Private Aided Primary and Secondary Educational Institutions), Rules, 1999. The court had noted that the Enquiry Officer had submitted a report dated 18.09.2024 and therefore, the question of changing the Enquiry Officer did not survive. The court had also observed that it would not go into the correctness or otherwise of the inquiry or the report - 5 - HC-KAR CNR: KAHC010373212025 NC: 2026:KHC:41778-DB CCC No. 668 of 2025 submitted by the Enquiry Officer. However, the court noted that if the complainant has any grievance, it would be open for the complainant to make a representation to the accused-management or the appropriate authority. 3. The learned Counsel for Accused No.5 has filed a memo along with documents indicating that the complainant's representation has been considered and an endorsement dated 24.05.2026 was issued. It is stated that the management has taken a decision to dismiss the complainant. 4. In view of the above, there is no occasion for this court to initiate proceedings under the Contempt of Courts Act, 1971. The complaint is accordingly closed.
