1. Instant petition has been filed seeking following reliefs:-
“(i) That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to produce all the relevant records relating to case of the petitioner before this Hon'ble Court for its kind perusal. (ii) That the Hon'ble High Court may kindly be pleased to set aside/quash the impugned order dated 09.02.2026 passed by Respondent No. 3, SP Rail Raipur, in part, in which the suspension JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2026.09.09 12:22:10 +0530
2 / 2 period of Petitioner from dated 05.12.2025 to 31.12.2025 (total 27 days) is declared as suspension period (Annexure P/3). (iii) That the Hon'ble High Court may kindly be pleased to direct the Respondent authorities to declare the suspension period from dated 05.12.2025 to 31.12.2025 (total 27 days) as duty period, and also release full salary and other consequential benefits to the Petitioner for the said suspension period. (iv) That this Hon'ble Court may kindly be pleased to give suitable compensation to the petitioner for the mental trauma and agony, harassment and hardships suffered by him as also cost of the litigation.”

Learned counsel for the petitioner submits that since minor punishment has been imposed upon the petitioner, as such the petitioner is entitled to get entire salary for the period when he was suspended. He has placed reliance upon a order placed by the coordinate bench of this court in WPS No. 5203/2020 in between Arvindra Kumar Koshti Vs. State of Chhattisgarh & ors. in which reliance is placed upon the
judgment passed by the Supreme Court reported in 2004 (1) MPHT 22 in between Y.S. Sachan Vs. The State of Madhya Pradesh and others as also the circular of the State Government dated 23/11/2010.
3. Considering the aforesaid aspect of the matter, since minor punishment has been imposed upon the petitioner which has not been disputed by the State counsel, this petition is allowed. The petitioner is entitled to get entire salary for the period when he was suspended. Sd/- (BIBHU DATTA GURU)
