17.08.2026 Serial no. 17 Court no.551 (MKP) CRM (A) 2396 of 2026 In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Raghunathganj PS Case No. 1461 of 2025 dated 19.11.2025 u/s 108/3(5) of the BNS 2023. -And- In the matter of : Sekha Majhi @ Seta Majhi … Petitioner Mr. Kunal Ganguly … for the petitioner Ms. Priti Kar Bagchi … for the State-respondent(s) 1. Learned advocate for the petitioner submits that the petitioner is aged about 61 years. He also stated that the investigation of the case is concluded. He prays for anticipatory bail. 2. Learned advocate for the State refers to the statement of the daughter of the victim recorded under Section 183 of the BNSS. 3. It is submitted that the victim subjected to torture by the petitioner which led her to commit suicide. She opposes the prayer for anticipatory bail. It transpires from the materials on record that their anticipatory 2 bail application was earlier refused by an order dated January 22, 2026 passed in CRM(A) 4321 of 2025. 4. Learned advocate for the State opposes the prayer for the anticipatory bail. 5. I have gone through the materials in the case diary as well as the order refusing anticipatory bail to the present petitioner. Such order records that there appeared prime allegations of torture against the present petitioner. Since the anticipatory bail of the petitioner was rejected by this Court and there has been no change in circumstance except the submission of charge-sheet. The statement recorded under Section 183 of the BNSS, shows that there are serious allegations as against the present petitioner. 6. In such circumstances, since there has been no change in circumstances, since the anticipatory bail application of the petitioner was refused, I am not inclined to grant the prayer of the anticipatory bail. 7. Hence, the prayer for anticipatory bail of the petitioner is Rejected. 8. CRM(A) of 2396 of 2026 is dismissed. (Md.Shabbar Rashidi. J)
