Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 83 days and has been detained on the basis of statement of co-accused although the recovery in the present case is 1.023kgs. of brown sugar.
Learned advocate for the State opposes the prayer for bail.
However, the materials supplied by the State do not contain any previous antecedents, CDR or money trail so far as the present petitioner is concerned. Only material available is statement of the co-accused. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner, namely, Sukhen Biswas shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees
2 Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court.
Thus, CRM(NDPS) 1649 of 2026 is allowed.
