THE DEPUTY DIRECTOR B C WELFARE, GUNTUR DISTRICT GUNTUR, A.P. - 522004 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of a Writ of Mandamus declaring the action of the respondents in proceeding with the departmental enquiry against the petitioner on the basis of a charge memo vide Rc.No.A1/02/2020 dated 16-05-2024 issued by the Collector and District Magistrate, Guntur which has already been set aside by this Hon’ble Court in W.P.No.11298 of 2026 dated 27-04-2026 without issuance of any fresh charge memo, as illegal, arbitrary, without jurisdiction, and in violation of Rule 9(2)(b) ii) of the A.P. Revised Pension Rules, 1980, and consequently set aside and quash the said enquiry proceedings, particularly the enquiry proceedings on charge memo vide Rc. No. A1/02/2020 dated 16-05-2024 of the Collector and District Magistrate, Guntur through the notice vide Memo Rc.No.Inquiry Officer/BCW/2026 dated 10-06- 2026, wherein the enquiry is proposed to be conducted on 16-06-2026 and pass such other order. IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to stay all further proceedings through Memo Rc.No. Inquiry Officer/BCW/2026 dated 10-06-2026, issued for conducting the departmental enquiry on 16-06-2026 on the basis of Charge Memo vide Rc.No.A1/02/2020 dated 16-05-2024, which has already been set aside by this Hon’ble Court in W.P. The present Writ Petition is filed questioning the action of Respondents in proceeding with the departmental enquiry against the Petitioner on the basis of a Charge-Memo issued by the District Collector-cum-District Magistrate, Guntur vide Rc.No.A1/02/2020, dated 16.06.2024, which has already been set-aside by this Court in W.P.No.11298 of 2026 on 27.04.2026 without issuing any fresh Charge-Memo and to declare the same as illegal and arbitrary. 2. At the time of hearing, the learned Assistant Government Pleader appearing for the Respondents does not dispute the fact that the Charge-Memo dated 16.06.2024 was quashed vide Order dated 27.04.2026 passed by this Court in W.P.No.11298 of 2026. The learned Government Pleader further submits that an Appeal has been filed thereon before the Division Bench of this Court and till any interim orders are passed suspending the order of the Co-ordinate Bench of this Court in W.P.No.11298 of 2026, no further steps would be taken against the Petitioner. 4 3. In that view, the grievance of the Petitioner is redressed and the Writ Petition is closed. 4. No order as to costs. 5.
