This is an application for anticipatory bail filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nabadwip Police Station Case No. 291 of 2026 dated 24.06.2026 under Sections 126(2)/117(2)/109/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Learned Advocate appearing for the petitioners submits that, due to political grudge, the present petitioners have been falsely implicated in the case. He further submits that there is a delay in lodging the FIR, which has not been properly explained. Accordingly, he submits that, considering these facts, custodial interrogation of the present petitioners is not necessary. 3. Mr. Sagar Saha, learned Advocate appearing for the State/respondents, produces the case diary and vehemently opposes the prayer for anticipatory bail of the petitioners on the basis of the materials available therein. He submits that petitioner nos. 1, 2 and 3 have criminal antecedents and are involved in another criminal case for 2 commission of offences punishable under Sections 447/379/427 of the Indian Penal Code. The Memo of Evidence filed in Court today is taken on record. 4. Heard the learned Advocates appearing for both the parties and perused the case diary as well as the other materials on record, including the injury report appearing at pages 22 and 26 to 30 of the case diary. 5. Considering the nature of the injuries as reflected in the injury report and further considering the fact that the incident allegedly occurred in presence of direct evidence, I am of the opinion that custodial interrogation of the petitioners is not necessary and that they may be granted anticipatory bail. 6. Accordingly, I direct that in the event of arrest, the accused/petitioners, namely, (1) Usman Mondal, (2) Firoj Mondal, (3) Lokman Mondal, (4) Tayej Mondal @ Taijaddin Mondal, (5) Bhola Mondal @ Nur Islam Mondal, (6) Fayjul Mondal, (7) Khaksar Mondal @ Khaksar Sekh, (8) Dustu Mondal @ Samsul Mondal & (9) Jhoro Mondal @ Anjat Ali Mondal, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the learned Judicial Magistrate, Nabadwip, Nadia and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall meet the Investigating Officer once in a week until submission of the charge sheet. 7. The application for anticipatory bail is, thus, disposed of.
