……Petitioner.

Mr. Anisur Rahman
Ms. Ankusha Ghosh
……for the Petitioner.
Mr. Somnath Adhikary Ms. Priyanka Bhattacharjee
……for the State.
Learned advocate appearing for the petitioner submits that the accusation against the petitioner relate to alleged recovery of 620 Gms. of Heroin. Other accused persons are absconding, although charge sheet has been submitted and as such there is no possibility of the trial being taken to its logical conclusion.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the Chemical Examiner’s Report which reflect presence of only one compound, i.e. 6- Monoacetylmorphine.
2
Taking into account the period of detention of the petitioner which is more than 7 months, I direct the learned Trial Court to split up the trial of the case after exhausting the process of law.
Learned Trial Court would within a period of 3 months after overcoming the stage of charges give priority and complete the seizure list witnesses.
Petitioner would renew his prayer for bail after the aforesaid stage is over.
With the aforesaid observations CRM (NDPS) 1655 of 2026 is dismissed at this stage.
Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
