ORAL ORDER The petitioner is accused No. 1 seeking regular bail in Crime No.15/2026 filed by the respondent/police for offences punishable under Sections 109, 54, 74, 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. The case of the prosecution is that on 18.01.2026, around 11.45 a.m., the children of the complainant were playing near a park. At that time, the son of one Yaseen was also playing along with them. A quarrel had ensued among the children. The complainant went to the spot, advised them, pacified the matter and sent them away from the place. After about fifteen minutes from the said incident, Yaseen allegedly came near the house of the complainant, started abusing him in

filthy language, and started a quarrel. In the course of the said quarrel, Yaseen and others assaulted the complainant and others, thereby causing injuries. Hence, the complaint came to be lodged. The investigation is under progress. 3. The learned counsel for the petitioner submits that, though the allegations against the petitioner are that he assaulted the complainant and his family members with a long chopper and a small chopper and caused injuries, the fact remains that the injured persons have been discharged from their respective hospitals. It is further contended that the injuries sustained are simple and grievous in nature. He is the earning member of the family and aged about 40 years, and a permanent resident of the address stated in the cause title. He will abide by the conditions to be imposed by this Court in the event of his release on bail. Making such a submission, he prays to allow the petition. - 4 -

Per contra, the learned High Court Government Pleader for the respondent/State vehemently submits that the petitioner is the main accused, who has caused injuries to the complainant and his family members by using deadly weapons such as a long chopper and a small chopper/machete. It is further contended that the offences alleged against the petitioner are heinous in nature and, therefore, he is not entitled to the relief sought for. If the petitioner is enlarged on bail, there may be chances of threatening the prosecution witnesses.
Hence, the Learned Additional State Public Prosecutor prays that the petition be rejected. 5. Heard the learned counsel for the respective parties. Perused the averments of the complaint. It appears from the record that the children were playing in a park situated near a Masjid at Rajeev Nagar, Mysuru City. A quarrel ensued among the children. The complainant went to the spot, pacified the matter and sent them out of the park. Thereafter, Yaseen, who is the

father of one of the children, came near the house of the complainant and started a quarrel. It is alleged that he, along with his associates, assaulted the complainant and his family members, as a result of which they sustained injuries. 6. The learned High Court Government Pleader for the respondent/State has produced the wound certificate of the complainant. Though it appears that the injuries sustained are grievous in nature, the fact remained that the injured has been discharged from the hospital. 7. The learned counsel for the petitioner submits that the petitioner is the sole earning member of his family. It is further submitted that the other accused persons have already been enlarged on bail by the learned Sessions Court and, on the ground of parity, the petitioner is also entitled to be enlarged on bail. Considering the same, it is appropriate to grant him bail by imposing suitable conditions. Hence, I proceed to pass the following:

ORDER i) The petition is allowed. ii) The petitioner is ordered to be enlarged on bail in Crime No.15/2026 filed by the respondent/police for offences punishable under Sections 109, 54, 74, 352 read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 on executing personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Trial Court. iii) The petitioner shall not threaten or tamper with the prosecution witnesses nor hamper the proceedings of the Court.
iv) The petitioner shall appear before the Investigation Officer till filing of the final report.
vi) The petitioner shall not indulge in any criminal cases till disposal of the case.

In case the petitioner violates any of the bail conditions as stated above, liberty is reserved to the prosecution to file a necessary application for cancellation of bail.
