In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 1209 of 2024 dated 12.12.2024 under Sections 21(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year 8 months. Charge sheet has already been submitted. Charges have already been framed and petitioner is unnecessarily detained in custody as there is no possibility of the trial being taken to its logical conclusion.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the Chemical Examiners Report which reflects presence of Diacetylmorphine (Heroin), 6- Monoacetylmorphine, Morphine-3-acetate, Acetylcodeine & Alprazolam and Trimethoprim, Oianzapine and 3-Hydroxy-2-
2 naphthoyl-ortho-anisidine. The quantity of contraband in the present case seized is 291Gms. of Brown Sugar.
Having regard to the contraband in the Chemical Examiners Report not being quantified and relying upon Sentu Seikh vs. State of West Bengal (SLP (Crl.) No. 13987/2025) I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Jiabur Rahaman @ Jiyaur Rahaman shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1622 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
