Learned advocate for the petitioner submits that there has been alleged recovery of 2640 bottles of Wincerex cough syrup and there has been no recovery from the present petitioner. The present petitioner has been implicated only on the basis of statement of a co-accused and is in custody for more than seven and half months. Learned advocate also submits that charge-sheet has also been submitted before the learned jurisdictional court, as such, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that there are money trail between the co-accused person. However, there has been no recovery from the present petitioner. 2 It has also been submitted on behalf of the petitioner that the co-accused with whom there has been monetary transactions, from him also no recovery was effected. Both the petitioner and the other co-accused are medicine shop owners/pharmacist. Having considered the overall circumstances, I am of the opinion that the whole case of the prosecution do not relate to any recovery from the present petitioner and is based on the statement of a co-accused from whom seizure has been effected, as such, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Alok Shil shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Dakshin Dinajpur without prior permission of the learned Special court/trial court.
Accordingly, CRM (NDPS) 1587 of 2026 is allowed. 3 Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
