Learned Counsel appearing on behalf of the petitioner submits that the petitioner is lady accused. She had physical relation with the victim who committed suicide. There was a long physical relation with the victim and when his husband came to know about the said relation she disclosed the fact to the victim and asked for stop the relation. Due to such communication, he committed suicide. The prayer for bail of the husband has already been granted by the Sessions Court. 2. Learned Counsel appearing on behalf of the petitioner submits anticipatory bail may be allowed on any terms and conditions. 3. Learned Advocate appearing for the State produces the case diary as well as memo of evidence and submits that there are call details between the victim as well as the 2 present accused, she was also extorting money from him and opposes the prayer for anticipatory bail. 4. Let the Memo of Evidence be taken on record. 5. Having heard the submission of the respective parties and on perusal of the materials-on-record and case diary, this Court do not find any statement in the call details. It is admitted fact that there was a physical relation between the victim and the present accused. From the Port Mortem Report it appears that he committed suicide by hanging. There are no other injuries in his body. 6. In view of the above facts and circumstances, this Court is of the opinion that custodial detention of the petitioner is not necessary in the instant case. 7. The petitioner is a lady accused and the prayer for anticipatory bail of the petitioner, namely, RUKSANA BIBI is allowed. 8. Accordingly, in the event of arrest, the petitioner shall be released on bail to the satisfaction of arresting officer on the terms and condition as he deems fit and proper and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner will not leave the geographical jurisdiction of Purba Medinipore without prior permission of the Investigating Officer. 9. In the event, the petitioner fails to comply with any of the conditions as imposed by this Court, the prosecution shall be at liberty to pray for cancellation of the anticipatory bail granted by this Court in accordance with law. 10. The application for anticipatory bail being CRM(A) 2028 of 2026 is, thus, allowed. 11. All concerned parties shall act on the server copies of this order duly downloaded from the official website of this Court. 3 12. Criminal Section is directed to supply urgent certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Ajay Kumar Gupta, J.)
