D/L16 12.08.2026 Bpg. C.R.M. (NDPS)1582 of 2026 In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Baduria Police Station Case No.72 of 2024 dated 23.02.2024 under Sections 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985; Firoj Ahamed Versus The State of West Bengal Mr. Debasis Kar Mr. Arka Tilak Bhadra Ms. Paramita Mukherjee. …for the petitioner. Mr. Parmanand Sharma Mr. R.R. Mohanty. …for the State. Learned advocate appearing for the petitioner submits that only 2 witnesses till date have been examined out of 9 witnesses by the prosecution. Learned advocate for the State opposes the prayer for bail as 11 litres of codeine mixture were recovered from the possession of the present petitioner. I have taken into account the period of detention of the present petitioner which is more than 2 years 5 months, consequently, as a matter of last chance, prosecution is directed to complete rest of the witnesses by 31st December, 2026. In case the same cannot be completed by the learned trial court for reasons beyond its control, in such event, the learned trial court would be 2 lenient in the bail of the present petitioner if such an application is filed after the aforesaid time period is over. With the aforesaid observations, CRM(NDPS)1582 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
