The present Criminal Writ Petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of mandamus directing respondent No.2 to protect the life and liberty of the petitioner and his family members from the alleged threats, harassment and assault at the hands of respondent No.4, who is also stated to have threatened them with dire consequences, including threats to their lives. 2. Briefly stated, the case of the petitioner is that he is an 83-year- old senior citizen. Respondent No.4 is his son, whereas the petitioner is presently residing with the family of his deceased elder son. It is the case of the petitioner that, out of love and affection and on the assurance that respondent No.4 would maintain and take care of him, he had transferred a substantial portion of his agricultural land in favour of respondent No.4. However, according to the petitioner, respondent No.4 has failed to honour the said assurance and disputes have arisen between them in relation to the petitioner's remaining property. CRWP-9138-2026 2 has been attempting to forcibly take possession of his remaining land and has been extending threats to him. 3. The petitioner, who is present in person, submits that respondent No.4 has repeatedly harassed and physically assaulted him and has threatened him with dire consequences. It is further submitted that, apprehending danger to his life and liberty, the petitioner submitted representations to the SHO, Police Station Barnala, the Senior Superintendent of Police, Barnala, and the Deputy Commissioner, Barnala, seeking protection and appropriate action against respondent No.4. However, according to the petitioner, no effective action has been taken on the said representations. The petitioner, therefore, submits that he continues to face a genuine apprehension to his life and liberty at the hands of respondent No.4 and seeks appropriate directions for his protection. 4.
Without expressing any opinion on the merits of the allegations made in the present petition, the same is disposed of with a direction to respondent Nos.2-Deputy Commissioner-cum-District Magistrate Barnala and respondent No. 3- Senior Superintendent of Police, Barnala, to consider and decide the representations submitted by the petitioner, in accordance with law, by passing a reasoned and speaking order, within a period of four weeks from the date of receipt of a certified copy of this order. 5. In the event respondent there is any substance in the grievance raised by the petitioner or perceive any genuine threat to his life and liberty, they shall take appropriate steps, strictly in accordance with law, to ensure adequate protection to the petitioner or proceedings for payment of maintenance under law.
