17.08.2026 Court No.35. D/L.07. Rakib (Rejected)
CRM (NDPS) 1635 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sankrail Police Station case no. 362 of 2025 dated 01.05.2025 under Sections 20(b)(ii)(C) of the NDPS Act.
And In the matter of : Subal Digal
……Petitioner. Ms. Sabrina Parveen
.....for the Petitioner. Mr. Dr. Pradip Banerjee Mr. Ushm Garodia
……for the State.
Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case. Learned advocate appearing for the State on the other hand opposes the prayer for bail and submits that 101.14 kgs of ganja were recovered from joint possession of the petitioner and others. Having considered the quantum of seizure in the present case, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted. As such, prayer for bail of the petitioner in CRM (NDPS) 1635 of 2026 is rejected. Memo of evidence submitted by the State be kept with the record.
