GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.15811 of 2026 O R DE R: The present Writ Petition is filed to declare the action of the Respondent No.5 in not concluding the Departmental Proceedings initiated against the Petitioner on 19.05.2025 vide Charge Memo No.2137797/CPR&RD/B3/2023, as illegal and arbitrary. 2. The facts leading to the filing of the Writ Petition are as follows: The Petitioner is working as Panchayat Secretary Grade-II, Allakurapadu Village, Tanguturu Mandal, Prakasam District. While so, a Charge Memorandum dated 26.02.2024 was issued on the Petitioner making certain allegations. Thereafter, the Petitioner submitted detailed explanation on the said Charge Memorandum. Dissatisfied with the explanation submitted by the Petitioner, the Respondent authorities suspended the Petitioner from service by Proceedings dated 26.02.2024 while initiating disciplinary proceedings. Thereupon, the Respondent Authorities issued Charge Memorandum vide Memo No.2137797/CPR&RD/B3/2023 on 19.05.2025. Even after more than one year had passed, the Respondent Authorities had not finished the disciplinary proceedings initiated against the Petitioner. Hence, the present Writ Petition 3. The learned Assistant Government Pleader submits that owing to administrative exigencies, the disciplinary proceedings initiated against the petitioner could not be concluded. He further submits that the 3 respondent authorities shall complete the proceedings expeditiously, within a time-bound period. 4. Having heard the respective counsel, it would be appropriate to direct the Disciplinary Authority to ensure that the enquiry shall be concluded within a period of six months from the date of receipt of a copy of this order as specified in G.O.Ms.No.91 General Administration (SER.C) Department dated 12.09.2022. 5. Accordingly, the Writ Petition is disposed of with the following directions: i) The Respondent No.5 shall conclude the Disciplinary Enquiry within a period of six months from the date of receipt of a copy of this order as specified in G.O.Ms.No.91 General Administration (SER.C) Department dated 12.09.2022. ii) There shall be no order as to costs.
